1. Agreement
These Terms of Service form an agreement between you and TheHawk. By creating an account or using the service, you agree to these terms and our Privacy Policy. If you use TheHawk for an organization, you confirm that you have authority to bind that organization.
2. Eligibility and accounts
You must be legally able to enter into this agreement and provide accurate account information. You are responsible for safeguarding your login credentials, for activity under your account, and for notifying us promptly if you suspect unauthorized access.
3. The service
TheHawk provides tools for property discovery, tenant and application workflows, communications, documents, and appointment coordination. Features may change as the service develops. TheHawk does not act as a real estate broker, landlord, legal adviser, financial adviser, or party to any rental agreement, and does not guarantee listing availability or a successful rental outcome.
4. Your data and responsibilities
You retain ownership of information and materials you submit. You grant TheHawk the limited rights needed to host, process, transmit, and display that content to operate and improve the service. You must have the necessary rights, notices, and lawful basis to provide personal information about tenants, applicants, agents, or other people and to send communications through TheHawk.
5. Acceptable use
You may not use TheHawk to break the law, infringe rights, discriminate unlawfully, misrepresent your identity, send spam or harmful content, access accounts or data without permission, interfere with the service, bypass security or usage controls, scrape the service, introduce malware, or reverse engineer the service except where applicable law expressly permits it.
6. Connected services
You may connect third-party services such as Google Calendar, Microsoft Outlook, OneDrive, Telegram, and payment or messaging providers. Your use of those services is also governed by their terms. You authorize TheHawk to exchange the information required to provide the integration. We are not responsible for third-party services, their availability, or changes they make.
7. Subscriptions and payment
Prices, plan limits, trial terms, and billing intervals are shown when you subscribe. Paid subscriptions renew automatically until cancelled. You may cancel future renewal through the available account controls. Fees already paid are non-refundable except where the service states otherwise or applicable law requires a refund. Taxes may apply.
8. Automated and AI-assisted features
TheHawk may use automated systems and AI-assisted features to score, summarize, draft, or organize information. These outputs can be incomplete or incorrect and are not legal, financial, housing, or professional advice. You remain responsible for reviewing outputs and for decisions, communications, and actions taken through your account.
9. Intellectual property
TheHawk and its licensors own the service, software, design, branding, and related intellectual property. Subject to these terms, we give you a limited, non-exclusive, non-transferable, revocable right to use the service for its intended business purpose.
10. Availability and disclaimers
We aim to provide a reliable service, but TheHawk is provided on an “as is” and “as available” basis. To the extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Calendar, notification, listing, and other external systems may be delayed, unavailable, or inaccurate, so you should verify time-sensitive information.
11. Limitation of liability
To the extent permitted by law, TheHawk will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities. Our total liability arising from the service will not exceed the amount you paid to TheHawk during the twelve months before the event giving rise to the claim. These limits do not apply where liability cannot legally be limited.
12. Suspension and termination
You may stop using the service or delete your account at any time. We may suspend or terminate access if you materially breach these terms, create security or legal risk, fail to pay applicable fees, or misuse the service. Provisions that by their nature should continue after termination will survive.
13. Changes
We may update the service and these terms. We will post updated terms here and change the effective date. If a change materially affects your rights, we may also notify you through the service or by email. Continued use after the updated terms take effect means you accept them.
14. Governing law
These terms are governed by the laws of the Netherlands, without regard to conflict-of-law rules. Disputes will be submitted to the competent courts of the Netherlands, except where mandatory law gives you the right to bring a claim elsewhere.
